 Advertising Terms and Conditions Agreement

The applicant has read and agrees to the contents found herein the Terms and Conditions document and ensures compliance.

1. Fees and Payments: Advertising fees are due and payable on an annual basis to retain the right to keep the signage posted. Full payment is due within 30 days of receiving your advertising contract.
2. Terms: The term of the contract is for a period of one year.

• All signage must be professionally made, and all costs associated with the design, manufacture, and delivery of the advertising sign are the responsibility of the Advertiser.
• The sign shall conform to the specifications outlined in the "Advertising Request Form" and shall contain only such artwork in good taste and is subject to review and approval by the Parks and Recreation Department.
• The Municipality of Brighton will attempt to place the Advertisement within the preferred location requested by the Advertiser. This does not represent or warrant that the Advertisement will be placed in the location requested. The Advertiser agrees that the Municipality of Brighton may allocate space on a "first come, first served" basis and acknowledges that the Municipality of Brighton decision on "location" is final and binding.
• If the Municipality of Brighton determines the appearance of the sign has deteriorated prior to the expiration of this contract, the Municipality of Brighton reserves the right to remove the sign and request the Advertiser to replace the sign at the sole cost of the Advertiser.
• The Advertiser shall not be entitled to any reimbursement relating to the annual maintenance shutdown or any other temporary or unplanned closure of the Arena.
• Upon the expiration of the term of the Agreement, the Municipality of Brighton may remove the sign unless the Agreement has been renewed and the appropriate fee for the new term has been received.
• The Municipality of Brighton may, without notice, at any time and for any reason remove a sign. The Municipality of Brighton shall reimburse the Advertiser for the pro-rated amount of the fee for the balance of the term during which the sign is removed.

3. Damage: The sign shall not become the property of the Municipality of Brighton, and the Municipality of Brighton does not assume responsibility for any wear and tear to the sign, caused by weather conditions and/or facility users. Should a sign be damaged by weather conditions and/or facility users, the Municipality of Brighton will notify the renter.

• The Municipality of Brighton is not responsible for vandalism, graffiti and/or mischief causing damage to/or destroying an advertisement. Should this take place, the Municipality of Brighton will notify the renter.
