Arena Terms and Conditions Agreement

The renter has read and agrees to the contents found herein the Terms and Conditions document and ensures the compliance of all persons using the facility while occupied by their rental group.

1. Term: All ice rentals for the season will be established by contract as per the Ice Allocation Policy. The use of changing rooms will be made available for all ice bookings 30 minutes prior to the beginning of the ice rental and will expire 30 minutes after the ice rental concludes.

• Every booking in the Arena includes 10 minutes for ice resurfacing for the next ice booking. This means that a 60-minute booking will result in 50 minutes on the ice.
• Ice will be flooded in between each ice rental, or as needed according to the Parks and Recreation staff. If a flood during a rental is needed, this must be requested beforehand. Participants must wait for the ice resurfacer to exit the ice and all doors to be closed before entering the ice surface.
• No food or drinks (other than water or sports drinks) are permitted to be on the ice or benches during a rental.

2. Insurance: The Municipality of Brighton insures activities with respect to individual & group users at the King Edward Park Arena. All Block User Groups are responsible for providing their own certificate of general liability insurance worth at least $5 million with the Municipality of Brighton listed as an additional insured. 
3. Fees and Payments: Full payment of the rented space is required at time of booking to guarantee the rental. If payment is not received, the Municipality reserves the right to cancel the booking and rent it to someone else. Payment can be made via cheque made out to the Municipality of Brighton, E-Transfer to parksrec@brighton.ca, or by cash payment made at King Edward Park Arena during office hours.
4. Cancellation Agreement: The Municipality of Brighton reserves the right to cancel the rental contract without notice at any time for any Municipal, Provincial, or Federal use, and/or close the facility due to inclement weather conditions, and/or emergency circumstances. Block user groups under contract may cancel scheduled ice time only under the following conditions:

• Severe weather conditions that make travel or participation unsafe
• Extenuating circumstance, as determined at the discretion of Parks and Recreation management.

  Outside of these exceptions, all contracted ice time is considered committed and non-refundable. By       signing the contract, user groups agree to uphold their scheduled time  and financial obligations.

5. No Soliciting: The sale of any food, beverages, and merchandise is strictly prohibited unless authorized by the Manager of Parks and Recreation.
6. Damage: If any damage is done to the facility, property, or equipment owned by the Municipality of Brighton during the rental period, the renter shall be held responsible for the financial coverage of the necessary repair as billed by the Municipality of Brighton. Any damage will result in additional charges of any needed repairs.
7. Lost Items: The Municipality of Brighton shall not be held responsible for any lost or stolen items, goods, or money in a dressing room or elsewhere. It is the responsibility of renters to lock or supervise their changing room during the duration of their rental.
8. Music Licensing: All events that intend to play music in any way (live, radio, digital, DJ, etc.) are subject to licensing fees as presented by SOCAN and ReSound. (Society of Composers, Authors and Music Publishers of Canada)
9. Consumption of Alcohol: Alcohol is strictly prohibited in any dressing rooms, on benches, or in the arena. If alcohol is found, this may result in termination of contract. The renter is responsible for ensuring all attendees follow these conditions during the rental period.
10. Smoking or Vaping: The entire King Edward Park facility is a no smoking zone. In accordance with the Smoke-Free Ontario Act, No person shall smoke or vape on the outdoor grounds of a community recreational facility and any public area within twenty metres of the facility.
11. Discrimination, Harassment, and/or Violence: The Municipality of Brighton values the diversity of its workforce, its patrons and visitors and the community in which we operate and is committed to providing an environment where individuals are treated with dignity and respect. Any person(s) who is found to be in the act of violating any provisions of this agreement or any by-laws, may be removed from the arena by a person authorized to enforce any provisions of this agreement or by-law if such person refuses to leave the hall within a reasonable time after being requested to do so.
