Sports Fields/Courts Terms and Conditions Agreement

 The applicant has read and agrees to the contents found herein the Terms and Conditions document and ensures the compliance of all persons using the facility while occupied by their rental group.

  1. Terms: All rentals for the season will be established by the signed contract as per the Fields/Courts Allocation Policy. The rented facility is only to be accessed within the rented time. Those who use sports fields and diamonds without authorization pre-season and/or during departmental closures will be charged and invoiced at the full, unsubsidized rate, and will be held responsible for the cost of field repairs. In addition, that group’s future use of booking contracts may be revoked. 
  2. Insurance: All user groups are responsible for providing their own certificate of general liability insurance worth at least $5 million with the Municipality of Brighton listed as an additional insured.
  3. Fees and Payments: Full payment of the rented space is required 24 hours in advance to guarantee the rental. Payment can be made via cheque made out to the Municipality of Brighton, E-Transfer to parksrec@brighton.ca, or by cash payment made at King Edward Park Arena during office hours.
  4. Cancellation Agreement: The Municipality of Brighton reserves the right to suspend the usage of any fields or courts due to unsafe or wet conditions that could damage the conditions of the field or court. The Two weeks notice must be given to receive a full refund. Any cancellations after two weeks will be charged, unless it is cancelled due to weather conditions, or an extenuating circumstance (under the discretion of Parks and Recreation management).
  5. No Advertising or Soliciting: The sale of any food, beverages, and merchandise is strictly prohibited unless authorized by the Manager of Parks and Recreation.
  6. Damage: If any damage is done to the facility, property, or equipment owned by the Municipality of Brighton during the rental period, the renter shall be held responsible for the financial coverage of the necessary repair as billed by the Municipality of Brighton. Any damage will result in additional charges for the needed repairs.
  7. Lost Items: The municipality of Brighton shall not be held responsible for any lost or stolen items, goods, or money during a rental. It is the responsibility of the renter to lock up or supervise their belongings during their rental.
  8. Consumption of Alcohol: Alcohol consumption is NOT permitted in the park except where Special Occasion Permit, OPP and Municipal permission under the Municipality of Brighton’s Municipal Alcohol Policy dictates.
  9. Smoking or Vaping: In accordance with the Smoke-Free Ontario Act, No person shall smoke or vape on the outdoor grounds of a community recreational facility and any public area within twenty metres of the chidlren’s play areas.
  10. Parking: Vehicles and parking are not allowed in any areas other than those designated for vehicle parking or vehicle access. Emergency vehicle access within and outside the park must be maintained at all times. Any barricades or other structures must be easily moveable for police ambulance and fire access.
  11. Discrimination, Harassment, and / or Violence: The Municipality of Brighton values the diversity of its workforce, its patrons and visitors and the community in which we operate and is committed to providing an environment where individuals are treated with dignity and respect. Any person(s) who disturbs the orderly and peaceful enjoyment of a public park, or is found to be in the act of violating any provisions of this agreement or any by-laws, may be removed from the park by a person authorized to enforce any provisions of this agreement or by-law if such person refuses to leave the public park within a reasonable time after being requested to do so.
